DF45JK close pass, Waverly Police wont issue a ticket

DF45JK driver passed me less than 50cm away. Reported to Waverly Police Station to Joshua Cibulka. He agreed it looked under 100cm but still chose not to issue a fine because him and fellow officers felt it would lose in court. Assuming the driver contested the ticket.

He said nothing can be done with close passes unless the cyclist is injured.
