Failed to give way

Car leaves the side of the road to cross into street opposite right in front of me. Not sure if the driver didn't see me or just thought that he should go anyway. He looked sheepishly at me for a moment before driving on. Driver in the ute at the intersection shook his head at the narrow miss.
