Youi insurance denying liability for careless driver

I was cycling on Dampier Avenue in City Beach on 20 Feb, 2025 and the driver (Piotr Ogonowski, Mirvac, City Beach Projects, City of Perth SLSC) reversed out of his driveway at 11 Dampier Avenue in the direction I was travelling. At the point of being stationary, (where I was already within close proximity to the car) I moved to the right to avoid the car. Piotr failed to give way, did not indicate to signal he was proceeding and then failed to indicate again when immediately turning right. We collided less than 2 seconds after he started to turn right and I crashed to the road. I was lying on the road for 20 minutes before the paramedics arrived as I could not move.

Youi, Piotr's motor vehicle insurer has been extremely frustrating to deal with. Youi has denied liability, leaving me with not only the injuries suffered, but a repair bill in excess of $16k for the bike and equipment damaged.

Three police prosecutors have viewed the CCTV footage and indicated the driver is at fault.
