Punishment pass by driver of untaxed Mercedes

Riding in primary due to oncoming traffic, I moved to secondary when safe to do so. The driver of the first vehicle to overtake me, moved fully into the other lane making a textbook pass, the second driver however simply put two wheels over the centre line and increased speed as he passed me, then had to brake hard as he nearly ran into the first vehicle. On checking later, the Vehicle Excise Duty for the Mercedes had expired the previous month.
